3.2 Server log files

The website provider automatically collects and stores information that your browser automatically transmits to us in "server log files". These are:

  • Time of the server request

None of this data will be merged with other data sources. These server log files will be deleted from the server after 14 days. We collect this data in order to serve our legitimate interests in displaying the website. The basis for data processing is Sec. 6 (1) (f) GDPR

3.3 Contact forms

On our website you will find forms for contacting us. When you use one of our contact forms, we collect the data you enter in the form, your IP address and the time the request was sent.

You can use the contact forms to request information and offers on furnished apartments (hereinafter: “Interested Party Form”), offer us properties for rent to potential tenants (hereinafter: “Offer Form”) or request information on the purchase and sale of properties (hereinafter: “Purchase and Sale Forms”).

Some details which we request in the contact forms are mandatory details which we have marked accordingly. We need this information in order to communicate with you. In addition, we require the mandatory information for the following:

  • Interested Party Form:  to create suitable offers for you
  • Offer Form: to determine whether we accept the property you offered
  • Purchase and Sale Forms: to contact you and advise you on the sale of your property, and evaluate your property, to make you an offer for purchasing a property or to answer questions about our services

The remaining data is voluntary information that we process to contact you personally. Additionally, we use the voluntary information for the following:

  • Interested Party Form: in order to better tailor our offers to your individual needs
  • Offer Form: in order to create a detailed exposé of your property and advise you on the rental of your property.

Under certain circumstances, we may forward your data to the following recipients or to their representatives:

  • Interested Party Form: to the landlord of the object
  • Offer Form: to prospective tenants
  • Purchase and Sale Form: to prospective buyers or potential sellers
  • When preparing a lease or sale: to Credit reference agencies for a credit assessment

We process this data in order to provide you with offers or in order to conclude a contract with you. The legal basis for processing the data is Sec. 6 (1) (b) GDPR. If your contact request is not for the purpose of preparing or concluding a contract with you but with a third party (e.g. if you act as an employee or representative ), we process this data to ensure our legitimate interest in sending you offers in response to your request or in concluding contracts with our customers. The legal basis in this case is Sec. 6 (1) (f) GDPR.

If your inquiry relates to a specific object or several specific objects, your data will be used to create further suitable offers, provided you have given us your consent to do so. The legal basis in this case is Sec. 6 (1) (a) GDPR.

3.4 Newsletter

If you have offered us properties for sale, we will also use your e-mail address for our newsletter to keep you informed about current developments on the rental market, news on real estate trends and interior design as well as other topics relating to your property. We use your e-mail address to send the newsletter with the help of our service provider. The newsletter is sent in order to ensure our legitimate interest in direct advertising to our existing customer base. The legal basis is Sec. 6 (1) (f) GDPR.

You may unsubscribe from the newsletter at any time by clicking the “unsubscribe” link provided in each newsletter or by sending us an e-mail using the contract details below.

We use newsletter tracking procedures to help us determine how often an e-mail has been opened and the links in the e-mail have been clicked on. If you click on a link in an e-mail, a cookie with an individual identification number is placed on your device. If, at a later point, you perform a certain action previously determined by us (e.g. create a search inquiry), we collect this data under a pseudonym in a report. We process this data to ensure our legitimate interest in measuring and optimizing the reach and impact of our newsletter. The legal basis is Sec. 6 (1) (f) GDPR.

3.5 Interhyp Mortgage Calculator

On our website, you have the option of obtaining offers for real estate financing. For this purpose, we have integrated the mortgage calculator of Interhyp AG, Domagkstr. 34, 80807 Munich (hereinafter "Interhyp") on our website. When you call up a page on which the calculator is integrated, your IP address is transmitted to Interhyp. This happens regardless of whether you use the calculator. If you enter data in the mortgage calculator and click on submit, this data will also be transmitted to Interhyp. 3.6 Surveys

We occasionally conduct surveys to improve the user experience and to tailor our service offerings to individual needs and preferences. Participation in the surveys is voluntary. With the help of our service provider we send the surveys, using your e-mail address. In addition to general questions regarding the use and satisfaction of our service, depending on the survey, we also ask you questions regarding your personal preferences when searching for apartments and/or real estate in the Munich area. The questions are selected at our discretion. Answering the questions does not constitute a claim to specific offers or the introduction of new functions.
In the surveys, we generally collect the following data: Your first and last name, your e-mail address, general information about your housing situation and your preferences when looking for housing and/or real estate in the Munich area, information about your profession and your age. The information you provide will be stored and - unless the evaluation is marked as anonymous in the survey - assigned to your person in order to offer you the best possible advice. You can request a copy of the information you provided in the survey, request that your survey information be deleted, or object to the use of your information at any time. We may make changes to parts of the website based on the information you provide in the surveys. This allows us to analyze and regularly improve our offer and make it more interesting for you as a user. We use the results of the surveys to adapt our service to your wishes and needs. This is done to serve our legitimate interest in providing you, as an existing customer, with the best possible user experience by means of direct advertising. 3.7 ProvenExpert

Our website uses plugins of the site provenexpert.com operated by Expert Systems AG. The provider of the sites is the Expert Systems AG, Quedlinburger Straße 1, 10589 Berlin. When you visit a page equipped with a ProvenExpert-Plugin, a connection to the Expert Systems AG server is established. This tells the ProvenExpert-server which of our pages you have visited.

The use of ProvenExpert is in our interest of an appealing presentation of our online offers. This constitutes a legitimate interest within the meaning of Sec. 6 (1) (f) GDPR. 3.8 INTEGRATION OF GOOGLE REVIEWS BY ELFSIGHT

We integrate Google reviews on our website using the service of Elfsight, LLC. This allows us to display customer reviews directly on our site, which increases transparency and trust in our services. Elfsight helps us to integrate these reviews in an efficient and user-friendly way.

Data collection by Elfsight

Elfsight collects the following data in order for the rating widget to function correctly:

  • Non-identifiable IP address: An abbreviated form of the IP address that does not allow personal identification.
  • Operating system: Information about the user's operating system to ensure compatibility and optimal display of the widget.
  • Browser type: Determining the browser type to adapt the display of the widget to different browser requirements.

This data is stored and analyzed for a period of 7 days only in order to monitor and improve the performance of the widget. Further information on data processing by Elfsight can be found in their privacy policy at https://elfsight.com/privacy-policy/.

Cookies

Elfsight uses the cookie "elfsight_viewed_recently" to prevent views of the widget from being counted multiple times within 15 seconds. This cookie is only stored for the duration of this time. You have the option of managing the use of this cookie via our privacy settings.

3.9 Chatbot “Your Digital Assistant”

We provide a chatbot service called “Your Digital Assistant” on our website, which acts as a digital communication assistant for our visitors.

Location of Data Processing:

Your data is processed in Germany on systems provided by Mr. Lodge GmbH. The data processor does not permanently store the data. If data processing outside Germany becomes necessary, you will be informed separately.

Retention Period for Collected Data:

Data from the chat history will be deleted no later than 180 days after collection.

Legal Basis for Data Processing:

4. Data Transmission

We will only pass on your personal data to third parties if:

  • you have given your consent to this in accordance with Sec. 6 (1)(a) GDPR.

  • this is necessary according to Sec. 6 (1) (b) GDPR for the fulfillment of a contract with you or for the implementation of pre-contractual measures (for example for credit assessment).

  • according to Sec. 6 (1) (c) GDPR, there is a legal obligation for the disclosure of the data (for example, within the framework of the statutory obligations of brokers under the Act on the Tracing of Profits from Serious Crimes, Money Laundering Act - GwG).

  • the disclosure is necessary in accordance with Sec. 6 (1) (f) GDPR for the protection of legitimate business interests and for the assertion, exercise or defense of legal claims and there is no reason to assume that you have an overriding interest worthy of protection in the non-disclosure of your data.

  • we use external service providers for data processing in accordance with Sec. 28 GDPR, i.e. so-called commissioned data processors, which have been contractually obligated by us to comply with the GDPR and to handle your data with care. We use commissioned data processors in the following areas: IT, telecommunications, marketing.

5. Analytics and advertising

5.1 Google Analytics

5.1.1 Recipients of the data

These companies are based in the USA. The level of data protection in the USA has not been recognized as equivalent to that in the EU. In this context, US authorities may also have access to your IP address.

Your IP address will therefore be shortened by Google within a member state of the European Union or in other contracting states of the Agreement on the European Economic Area before being transmitted to the USA. Only in exceptional cases will the full IP address be transmitted to a Google server in the USA and shortened there. In addition, we have concluded the EU standard contractual clauses with Google to ensure an appropriate level of data protection.

5.1.2 Purpose of data processing and storage period

Google will use this information on behalf of the operator of this website to evaluate your use of the website, to compile reports on website activity, and to provide other services regarding website activity and Internet usage for the website operator. This evaluation enables us to improve our website on the basis of the information about how it is being used, in order to adapt it to your needs and to make it more user friendly. 5.2 Google Analytics Remarketing

Our websites use the features of Google Analytics Remarketing combined with the cross-device capabilities of Google AdWords and DoubleClick. This service is provided by Google Inc., 1600 Amphitheater Parkway, Mountain View, CA 94043, USA. This feature makes it possible to link target audiences for promotional marketing created with Google Analytics Remarketing to the cross-device capabilities of Google AdWords and Google DoubleClick. 5.3 Google AdWords and Google Conversion-Tracking

This website uses Google AdWords. AdWords is an online advertising program from Google Inc., 1600 Amphitheater Parkway, Mountain View, CA 94043, United States ("Google"). As part of Google AdWords, we use so-called conversion tracking. When you click on a Mr.Lodge-ad served by Google, a conversion tracking cookie is set. 5.5 Mailingwork

We send our newsletter using the provider Mailingwork GmbH ("Mailingwork"), Birkenweg 7, 09569 Oederan, Germany. The email addresses and names of our newsletter recipients are stored on our behalf on Mailingwork's servers in Germany. Mailingwork uses this data to send and evaluate the newsletters exclusively on our behalf, but not for its own purposes. There is a data processing agreement between Mailingwork and Mr. Lodge GmbH, which obliges Mailingwork to comprehensively protect your personal data from unauthorized access and to process your data in accordance with the German Data Protection Act (GDPR). In addition, Mailingwork has been certified as a reputable email marketing service provider by the Certified Senders Alliance.

Our newsletters sent with Mailingwork allow us to analyze the behavior of newsletter recipients. Among other things, we can analyze how many recipients opened the newsletter message and how often which link in the newsletter was clicked. With the help of so-called conversion tracking, it can also be analyzed whether a predefined action (e.g. your search query on our website) has taken place after clicking on a link in the newsletter. In order to regularly improve our website and align it with your requirements and needs, we use the website analysis tool “Matomo”. For this purpose, Matomo evaluates your usage behavior on the website and creates reports and statistics for us. We use Matomo in the cloud variant. Matomo is a service provided by InnoCraft Ltd., 7 Waterloo Quay, PO Box 625, 6140 Wellington, New Zealand (“Innocraft“). Your data is stored on servers located in the European Union. In addition, the European Union has recognized the level of data protection in New Zealand as comparable to that in the European Union.

Matomo records your usage behavior on our website using the so-called config_id. The config_id is a string calculated for each visitor based on their operating system, browser, browser plugins, IP address and browser language. Matomo uses the data which your end device transmits to our server for technical reasons when you call up the page. There is no access to data stored in your end device. With the config_id, Matomo summarizes various actions of website visitors in a short time window of up to 24 hours. After 24 hours at the latest, the config_id loses its validity.

In some cases, however, Matomo requires cookies to be set. These are purely functional and do not collect any personal data. They serve only to increase the security and privacy of users.

The essential cookies and the reasons for which they can be set are:

  • piwik_ignore
    When choosing the op-out method under 5.6.3, Matomo creates the piwik_ignore cookie, so that Matomo will not analyse your further visits to our website.
  • MATOMO_SESSID
    MATOMO_SESSID is a temporary, short-lived cookie that provides a Nonce – basically a random number – to prevent security problems while you exclude tracking under 5.6.3.
  • _pk_testcookie
    The _pk_testcookie is used only to check whether your browser supports cookies and is created without identifier and deleted directly.

6. Plugins and Tools

6.1 YouTube

Our website uses plugins from YouTube, which is operated by Google. The operator of the pages is YouTube LLC, 901 Cherry Ave., San Bruno, CA 94066, USA. These plugins are all included in the “Advanced Privacy Mode”, which means that no data about you as a user will be transferred to YouTube if you do not play the videos. Only when you play the videos will data be transferred to YouTube. We have no influence on this data transfer.

If you visit one of our pages featuring a YouTube plugin, a connection to the YouTube servers is established. Here the YouTube server is informed about which of our pages you have visited. This is independent of whether you have a YouTube account or not. If you are logged in to your YouTube account, you enable YouTube to assign your browsing behavior directly to your personal profile. Youtube stores your data as user profiles and uses them for the purposes of advertising, market and/or tailoring its website to suit your needs. This site uses the Google Maps map service via an API. It is operated by Google Inc., 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA. 6.3 Matterport

Our website offers 360-degree photographs (virtual tours) of some properties. These virtual tours are integrated into our website via the my.matterport.com portal. The portal is operated by Matterport, Inc., 352 E. Java Dr. Sunnyvale, CA 94089, USA. When you visit one of our sites containing such 360-degree photographs, a connection to Matterport’s servers will be established. The Matterport server will be informed which of our pages you have visited. Matterport also obtains your IP-address. This also applies if you are not logged in to Matterport or if you do not have an account with Matterport. The information obtained by Matterport is transmitted to the Matterport server in the USA.

If you are logged in to your own Matterport account, you allow Matterport to associate your browsing activity directly with your personal profile. The use of Matterport is in the interest of presenting our online offers in a appealing way. This constitutes a legitimate interest within the framework of Sec. 6 (1) ( f) GDPR.

6.4 Feelestate

On our website, we display panoramic images or 360-degree images of the properties; the footage is embedded on our website via the "Feelestate" tool. The provider of the "Feelestate" tool is AVANTO VR Solutions GmbH, Otto-Lilienthal-Straße 16a, 28199 Bremen (hereinafter "AVANTO"). In order for the panoramic images to be displayed to you accordingly, your browser establishes a connection to the servers of the provider AVANTO. In the process, your IP address is transmitted to AVANTO. We have no influence on this transmission of your data. The data transmission is absolutely essential for the use of the "Feelestate" tool.

6.5 DocuSign eSignature

We use DocuSign eSignature by DocuSign, Inc. 221 Main Street, Suite 1550, San Francisco, CA 94105, USA ("DocuSign") to process personal data in connection with the signing of rental contracts and of extensions of leases (e.g. full name, contact information, company, job title, signature). The use of DocuSign serves our legitimate interest in simplifying and accelerating the process of legally valid signing of contracts and documents through the use of an electronic signature. The legal basis for the processing is Sec. 6 (1) (f) GDPR. When providing the DocuSign service, the transfer of personal data to the USA cannot be ruled out. As a data processor, DocuSign maintains binding internal data protection regulations (Binding Corporate Rules - BCR).
